These Terms and Conditions (“Terms”) govern your use of the Goodeebag website (“Website“) and any services offered therein. By accessing or using the Website, you agree to be bound by these Terms.

1. Acceptance of Terms

  1. By accessing or using the Website, you explicitly acknowledge that you have thoroughly read, comprehensively understood, and unequivocally agreed to be bound by these Terms, encompassing any supplementary terms, conditions, and policies referred to herein. Your utilization of the Website constitutes a legally binding agreement between you and the Website, establishing your acceptance of all provisions outlined herein.

2. Responsible use and conduct

  • In order to access our Resources, you may be required to provide certain information about yourself (such as identification, email, phone number, contact details, etc.) as part of the creation of an account, or as part of your ability to use the Resources. You agree that any information you provide will always be accurate, correct, and up to date.
  • Accessing (or attempting to access) any of our Resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical or unconventional means.

Our data collection and processing activities are primarily conducted for the purpose of service provision enhancement, communication facilitation, and legal compliance.
  •  Disclosure of your personal information may occur in adherence to legal requirements. We maintain stringent security protocols to protect the integrity of your data and adhere to prescribed retention periods. You are entitled to exercise your rights regarding data access and control. 4. Voluntary Participation in Dry Waste Exchange Program

  • By participating in Goodeebag’s waste exchange program, you are voluntarily agreeing to provide waste to the Goodebag in exchange for reward points which you will receive on the Goodeebag’s app. You certify that the waste you provide is legitimate and meets the criteria set forth by Goodeebag.

5. Reward Points

  • For every 1 kg of waste, you will accrue 2 redeemable points on the Goodeebag’s app. The accumulated points can be redeemed within the Goodeebag app for various rewards and benefits offered by Goodeebag.
  • Reward points earned through the waste exchange program have no monetary value and cannot be redeemed for cash.

6. User Conduct

  • Users are solely responsible for their conduct on the Website. You agree not to use the Website for any unlawful or prohibited purpose, including but not limited to:
  1. Violating any applicable laws or regulations.
  2. Infringing upon the rights of others.
  3. Posting or transmitting any content that is defamatory, obscene, or offensive.
  4. Interfering with the operation of the Website.

7. Participation in POSH Act Compliance

  • Goodeebag complies with the Prevention of Sexual Harassment (POSH) Act and expects all users to adhere to its provisions. Users are prohibited from engaging in any form of harassment, discrimination, or inappropriate behavior on the Website. Any violation of the POSH Act will result in immediate termination of access to the Website and may be reported to the appropriate authorities.

8. Intellectual Property

  • All content and materials available on the Website, including but not limited to text, graphics, logos, images, and software, are the property of Goodeebag and are protected by copyright, trademark, and other intellectual property laws. You may not modify, reproduce, distribute, or display any portion of the Website without the prior written consent of Goodeebag.

9. Disclaimer of Warranties

  • The Website is provided on an “as is” and “as available” basis without any warranties of any kind, express or implied. Goodeebag does not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Website at your own risk.

10. Limitation of Liability

  1. In no event shall Goodeebag be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of the Website or the dry waste exchange program, whether based on contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.

11. Governing Law

  1. These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Delhi.

12. Arbitration

  1. This Agreement shall be governed by, and construed and enforced in accordance with, the laws of India. However, in case any dispute arises, the Parties shall strive to amicably resolve such dispute or difference within thirty (30) days of arising of such dispute or difference. If the parties fail to amicably resolve the dispute or difference within 30 days of arising of such dispute or difference, the same shall be referred to the Arbitration in New Delhi in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended till date) by a Sole Arbitrator duly appointed by the Delhi International Arbitration Centre (DIAC).
  1. The language of the Arbitration proceedings shall be English. The Arbitration Award shall possess conclusive and binding authority over the involved parties, and either party retains the right to seek enforcement of said award through application to a court of competent jurisdiction.

13. Changes to Terms

  1. Goodeebag reserves the right to modify or revise these Terms at any time without prior notice. By continuing to use the Website after any such changes, you agree to be bound by the revised Terms.

Disclaimer:

  1. The estimates of CO2 footprint reduction, waste recycled and the number of trees saved, based on the dry waste provided, may be displayed on the website for transparency. However, these estimates are provided solely by Goodeebag and Goodeebag does not guarantee the accuracy or exactness of these estimates. They are provided as an approximation for informational purposes only.
  2. Be aware that the rates provided to the customers by Goodeebag are not market-based. Goodeebag is not obligated to align its prices with market fluctuations or competitor pricing. As such, Goodeebag reserves the right to determine prices for its products and services independently, without guaranteeing conformity to prevailing market rates. Customers acknowledge and accept that pricing may vary and are not contingent upon market standards.
